Birth Injury Compensation Claims
Navigating a birth injury compensation claim can be incredibly overwhelming and emotionally draining, and so it's important to have proper legal guidance and support to ensure your case is dealt with as seamlessly as possible.
What is birth injury?
Birth injury is any kind of physical injury inflicted on either mother and/or baby during the birthing process.
In some cases, birth injury can also include any psychological damage caused as a result of a traumatic birth.
What are the types of birth injuries?
Birth injuries can be split into injuries to the mother and injuries to the baby.
Birth injuries to mother:
- Pre-eclampsia
- Haemorrhages
- Perineal tears
- Uterine prolapse
- Complications with anaesthetics
- Infections
Birth injuries to baby:
- Cerebral palsy
- Oxygen deprivation
- Erb’s palsy
- Hyperbilirubinemia
- Broken bones
- Shoulder injuries (due to the use of forceps or getting stuck in the birth canal)
- In some extreme circumstances, stillbirth
What causes birth injuries?
Birth injuries can be caused by a variety of different factors but most injuries occur during the baby’s journey through the birthing canal shortly before delivery.
Below are some of the most common causes of birth injury:
Delayed birth
A birth lasting over 18 hours is classed as a delayed birth. In delayed births, pressure on the infant's brain increases and can result in foetal distress and elevated blood pressure, resulting in further complications and injuries.
Oxygen deprivation
This is a very serious birthing complication and can cause a wide range of injuries to infants, such as brain injuries. Lack of oxygen can occur due to a prolapsed umbilical cord, or because of underdeveloped lungs in premature infants.
Medical malpractice
A doctor may be liable for birth injuries due to excessive force or medical negligence/malpractice. Inexperienced or impatient doctors may misjudge the situation, such as using forceps or vacuums unnecessarily.
There are also other causes of birth injuries, such as when the child’s body is improperly manipulated during delivery.
Birth injury compensation
The amount of compensation you can be awarded for birth injury claims entirely depends on the unique nature of your case.
For example, more severe cases will often receive higher pay-outs to compensate for the pain, suffering and/or loss inflicted upon the family.
A dedicated birth injury lawyer will strive to achieve the best possible compensation for you, taking into account any suffering you have endured, the severity and complexity of the case, and any expenses incurred as a result.
The stillbirth compensation amount in the UK can vary anywhere between £5,000 to £500,000.
